Legal & Platform Policies

Terms of Use

Effective Date: October 2026 · These Terms of Use govern all bookings, equipment listings, transactions, and services offered through BigFootRental.

1

1. Acceptance of Terms

By accessing, browsing, registering on, or using the BigFootRental platform (the "Platform", "we", "us", or "our"), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use, our Privacy Policy, and any additional rental agreements or equipment checklists executed on the Platform.

If you are entering into these terms on behalf of a company or other legal entity, you represent and warrant that you have the full legal authority to bind that entity to these Terms. If you do not agree to these terms, you must discontinue using the Platform immediately.

2

2. Marketplace & Intermediary Role

BigFootRental operates an online marketplace and technological platform designed to facilitate heavy equipment rentals by connecting verified independent equipment owners and fleet operators ("Vendors") with registered contractors, businesses, and individuals seeking to hire machinery ("Renters" or "Customers").

Intermediary Clarification:

Unless expressly stated in a specific listing, BigFootRental acts as a technology intermediary and booking facilitator. The underlying rental contract is formed directly between the Renter and the Equipment Vendor, subject to the standard platform rental agreement and verified handover inspection.

3

3. Account Registration & Verification

  • Eligibility: Users must be at least 18 years of age and legally capable of forming binding contracts under applicable jurisdiction.
  • Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile, billing details, and identity documents updated.
  • Security: You are responsible for safeguarding your login credentials and authentication tokens. Any action performed through your verified account will be deemed authorized by you.
  • KYC & Verification: BigFootRental reserves the right to verify business registrations, GSTIN/tax credentials, identity proofs, and operator licenses prior to approving equipment bookings or vendor listings.

4

4. Equipment Listings & Bookings

Vendors are solely responsible for accurately describing machinery specifications, operational hours, year of manufacture, rental units (hourly, daily, weekly, monthly rates), location, and availability schedules.

A booking request submitted by a Renter constitutes an offer to hire the designated equipment. A booking is confirmed only upon successful payment authorization, security deposit escrow allocation, and digital acceptance by the Vendor.

5

5. Pricing, Security Deposit & Taxes

All rental fees are calculated according to the rates displayed at the time of booking confirmation, plus any applicable taxes (such as GST), transportation charges, operator fees (if requested), and optional insurance covers.

Security Deposit Escrow: Renters must provide a refundable security deposit prior to equipment dispatch. Deposits are held safely and refunded within 3 to 7 business days following satisfactory machine return and completion of the check-out checklist, minus any verified dues or damages.

6

6. Handover, Inspection & Checklists

To maintain complete transparency and prevent disputes, both Vendor and Renter must execute the mandatory Digital Handover Checklist at:

  • Check-in (Dispatch/Delivery): Verification of hour meters, fuel levels, fluid levels, tire/track condition, safety alarms, and existing cosmetic marks.
  • Check-out (Return/Off-hire): Inspection of final hour meter readings, mechanical state, cleanliness, and return condition against the dispatch baseline.

Discrepancies not recorded during the initial handover checklist cannot be claimed retrospectively.

7

7. Machine Operation & Safety

Renters agree to operate machinery strictly in accordance with manufacturer guidelines, safety protocols, load limits, and statutory workplace regulations. Machines must be operated only by certified, sober, and competent personnel.

Breakdown Support: In the event of mechanical breakdown or malfunction, the Renter must immediately cease machine operation and notify both the Vendor and BigFootRental Support Desk through the Platform. Unauthorized third-party repairs or modifications are prohibited.

8

8. Cancellations, Refunds & Extensions

Cancellations made prior to machine dispatch are subject to the cancellation policy tier selected by the Vendor (standard cancellation allows full refund when requested at least 24 hours prior to scheduled dispatch).

Rental extensions are subject to equipment availability and must be booked through the Platform before the active rental period expires to maintain insurance coverage.

9

9. Damage, Loss & Liability

Renters are responsible for loss, theft, vandalism, or damage to equipment arising from negligence, improper use, unauthorized operators, or site hazards during the rental period.

To the maximum extent permitted by applicable law, BigFootRental its directors, employees, and agents shall not be liable for indirect, incidental, punitive, or consequential damages, including loss of profits, project downtime, or site delays.

10

10. Vendor Obligations

Vendors warrant that all equipment listed on the Platform is legally owned or leased with right to sub-rent, in sound mechanical working order, fully serviced, and compliant with statutory emissions and safety norms.

11

11. Prohibited Conduct

Users of the Platform agree not to:

  • Circumvent platform billing or solicit off-platform transactions after discovering equipment via BigFootRental.
  • Sub-rent, pledge, or transfer rented machinery to third parties without prior written consent.
  • Tamper with GPS tracking units, hour meters, or serial number plates on equipment.
  • Use automated scripts or scrapers to copy catalogue data or pricing.

12

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where BigFootRental is incorporated. Any legal action or dispute arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in the registered headquarters region.
